Roof permits and the BC Building Code in Ladysmith

A building permit is a municipality's or regional district's approval that planned work meets the BC Building Code before it starts. Each municipality and regional district sets its own rule, not the province — that's why four communities just a few kilometres apart can have four different answers for the same job.

Why a permit matters
A building permit gives you a paper record that the work meets the BC Building Code, which matters when you sell the house or file an insurance claim. Skipping a permit that was required doesn't just risk a stop-work order — it can also complicate a future sale, since a buyer's lender or insurer may ask for proof the roof was done to code. Where a permit is required, we build the time to apply for it and wait for approval into the project schedule before tear-off starts.
Repairs versus a full re-roof
Most of the exemptions above apply to a straightforward re-roof — stripping the old material and installing new shingles or metal in the same configuration. The moment a job involves structural work, such as replacing damaged sheathing or reframing a section of roof, North Cowichan and RDN Area A both require a permit even though routine re-roofing is exempt there. We flag that distinction during the initial roof assessment, before a quote is written, so the scope is set before work starts.
The code applies either way
Even where a permit isn't required, the work still has to meet the same BC Building Code standards a permitted job does — minimum shingle slope, eave protection at the roof edge, and adequate attic ventilation. Skipping the permit doesn't mean skipping the code. We build to code on every job, permit or no permit.
Town of Ladysmith
Re-roofing and other alteration work isn't on the exemption list in the Town of Ladysmith's Building & Plumbing Bylaw, so a building permit is required. Homeowners in Ladysmith should apply for a permit before starting a full roof replacement. Because the bylaw doesn't carve out an exemption for roofing specifically, even a straightforward like-for-like shingle swap needs a permit there, unlike in three of its four neighbouring jurisdictions.
Municipality of North Cowichan (Chemainus)
Re-roofing and re-cladding are exempt from a permit in the Municipality of North Cowichan, unless the work involves structural repairs or the insulation is also being replaced or upgraded at the same time. Chemainus homeowners doing a straightforward shingle or metal roof swap generally don't need a permit. Insulation upgrades are treated the same way as structural work for permit purposes, even on an otherwise straightforward re-roof.
Regional District of Nanaimo, Area A (Cedar)
Roofing repairs and replacement are exempt from a permit in RDN Electoral Area A, which covers Cedar, South Wellington, Yellowpoint and Cassidy, provided no structural changes are made. A permit is still required if the work goes beyond a straightforward re-roof. That's a narrower exemption than it might sound — adding a skylight or reframing a dormer during the same project counts as a structural change.
Cowichan Valley Regional District, Area G (Saltair)
The CVRD administers building permits for Electoral Area G, which covers Saltair, but its Building Regulation Bylaw sets no roofing-specific exemption that could be confirmed from a primary source. Saltair homeowners should check directly with CVRD Building Inspection before starting a re-roofing project to find out whether their specific job needs a permit. In the meantime, we treat a Saltair re-roof the same way we'd treat one in a jurisdiction that does require a permit — confirming the requirement in writing before work starts, so there's no ambiguity later.

Inspections and sign-off
If your project needs a permit, expect at least one inspection during the work and a final sign-off once it's done. We coordinate scheduling with the local building department so an inspection never holds up the rest of the job longer than necessary.
